This contract sets out the terms under which the BaiaKing team gives you access to an account to play the online RPG BaiaKing. It works together with the Terms of Service, the Privacy Policy and the Server Rules.
1.Introduction
By creating an account, using the website or playing BaiaKing, you accept this contract, the Terms of Service, the Privacy Policy and the Server Rules.
If you do not agree with them, do not use the website or the game. Continuing to use either after a change means you accept the updated version.
We may update this contract when the law, regulators or the needs of the service require it. The current version is always published on this page, with the date of its last change.
2.Age and Responsible Play
You must be at least 13 years old to create an account. If you are under 18, or under the age of digital consent in your country (up to 16 in the European Union), you may only play with the permission of a parent or legal guardian, who accepts this contract on your behalf.
Spending long periods playing video games can affect your physical and mental health. Take regular breaks, keep healthy gaming habits, and look for professional help if you or someone you know shows signs of gaming addiction.
3.The Service
BaiaKing is a free game run by an independent team and provided "as is". We do our best to keep it running, but we cannot guarantee that the game, the client, the website or your account will always be available, free of errors or free of vulnerabilities.
We are not responsible for events beyond our control that affect the game, such as hardware failures, attacks by third parties (for example hacking or DDoS), or interruptions of internet or hosting providers.
4.Limitation of Liability
To the extent permitted by law, the BaiaKing team is not liable for lost progress, items, characters or data, or for indirect damages, caused by errors, maintenance, rollbacks or changes to the game.
Nothing in this contract excludes or limits liability that cannot be excluded by law, such as liability for intent or gross negligence, or the rights you have as a consumer under the law of the European Union and of your country of residence.
5.Your Obligations
- Follow the Server Rules published on this website. Breaking them may lead to the suspension or deletion of your account, with no refund.
- Keep your password, recovery codes and access to your email secure. You are responsible for everything done with your account.
- Do not use cheats, unauthorised software, bugs or any other means to gain an unfair advantage, and do not try to disrupt the service or other players.
6.Data Protection (GDPR)
We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR). We use your data only to provide the game, to keep accounts secure and to protect the game against cheating, fraud and abuse — never for advertising, and we do not sell it.
To protect accounts we record sign-ins with their IP address and the device they came from (browser details, or a hashed hardware identifier of the game client). The legal basis for this is our legitimate interest in the security of the service (Article 6(1)(f) GDPR); the account itself is based on this contract (Article 6(1)(b)).
You have the right to access, correct and delete your data, to restrict or object to its processing, and to data portability. To exercise them, contact the staff on Discord. You also have the right to lodge a complaint with the data protection authority of your country.
The Privacy Policy explains in detail what we collect, why, and for how long.
7.Disputes and Applicable Law
If you have a problem, please contact the staff on Discord first: most issues can be solved there.
If you live in the European Union, you keep the protection of the mandatory consumer law of your country of residence, and you may bring a claim before the courts of that country.
8.Final Provisions
This contract, together with the Terms of Service, the Privacy Policy and the Server Rules, is the entire agreement between you and the BaiaKing team about the game and the services offered.
If any clause is found invalid, the remaining clauses stay in force.
We may take appropriate action, including legal action, if these terms are broken.
